Grade Pending is not a bad grade. It is an unfinished sentence
Personalizadoers read Grade Pending as a warning. It usually means the operator disagreed with the score and is waiting on a hearing — which is their right.
A Grade Pending card in a window makes people hesitate on the pavement. Most of them have no idea what it means, and what they assume is worse than the truth.
What it actually means
You did not earn an A on your initial inspection. You were scored but not graded. An inspector came back — unannounced, at least seven days later and usually within a month — and that re-inspection produced a B or a C.
At that point the Department gives you two cards: the letter grade, and Grade Pending. You may post either one until you have had your chance to be heard at the Health Tribunal.
Posting Grade Pending is not hiding. It is the card the city issued you, for exactly this situation, because the score is genuinely not final until a hearing decides it.
Why an operator would choose it
Because scores change at hearings. Violations get dismissed when the operator turns up with evidence — a service record showing the equipment was repaired, photographs showing the condition was different, a receipt dated before the inspection.
If you believe two of your violations will not survive a hearing, and losing them takes you from 15 to 11, then the B in your window is a number you do not think is true. Grade Pending says so, honestly, until someone decides.
Why an operator would choose the letter instead
Because Grade Pending makes some customers assume the worst, and a B does not.
A B is a known quantity. Most New Yorkers have eaten in a B and lived. Grade Pending is ambiguous, and ambiguity in a restaurant window tends to get read down rather than up.
If your B is fair and you are not contesting it, posting the B is often better business than posting the pending card. The hearing will not change it, and the card that says nothing definite is the card people worry about.
The thing to be clear about
Grade Pending is not a way to avoid posting a bad grade indefinitely. The window closes the moment your hearing is decided, or the moment you miss it.
If you accept a settlement, post the letter grade and destroy the pending card. If you default, same. If you adjourn twice, same.
The card is a placeholder for an unfinished process, and when the process finishes it stops being true.

A Grade Pending card tells you a re-inspection happened and a hearing has not. It does not tell you the restaurant is dirty, and it does not tell you it is clean.
The full inspection record — every violation, every score, every date — is public. You can look up any restaurant in the city and read it for yourself in about thirty seconds. That will tell you far more than a card in a window.
