The roadway café comes down. The sidewalk one does not

Two structures, two sets of rules, and the difference matters most in November.

Roadway cafés — the ones in the parking lane — are seasonal. They operate 1 April to 29 November and come down for the winter.

Sidewalk cafés operate año-round.

So for a lot of operators, 29 November is not the end of outdoor dining. It is the day half of it goes away and the other half has to work in the cold.

What happens to the covers you were using

The setup that carried you through October was designed for a mild evening. Winter changes what you need and what is permitted.

Enclosures, heaters and coverings all have rules attached, and the ones that matter are not primarily dining rules — they are fire rules. Propane storage in particular is a fire code question with real consequences, and it is the thing most likely to be got wrong by an operator improvising in December.

Before you buy heaters, find out what you are permitted to use and where fuel may be stored. Ask FDNY guidance, not the supplier selling you the heater.

The teardown itself

Storing a roadway café is not free of consequence. Where the material goes matters.

Stacked timber and panels against a back wall is a harborage condition — the same one that shows up as 08A on a health inspection, worth points, flagged critical. Rodents do not distinguish between a pallet of café decking and any other pile against a wall.

If the disassembled café is going to live on your property for four months, it needs to be stored up off the ground, away from walls, and somewhere it will not accumulate standing water.

What to do in the two weeks before

1. Book the teardown rather than doing it on the twenty-ninth in the rain.
2. Decide where the material goes before it comes down, and check that spot against the harborage rules.
3. Photograph the sidewalk café setup as it will run through winter, so you have a record of the configuration you operated.
4. Check heater and enclosure rules before you commit money.

The thing that catches people in January

The sidewalk café that ran happily all summer becomes a snow and ice question in winter. Clearance, obstruction and the path pedestrians actually use are all still enforced when there is a snow bank where your clearance used to be.

An arrangement that was legal in August can be an obstruction in February without anyone moving a table. Walk it after the first real snow and look at it the way an inspector standing on the pavement would.
